RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT

This Release of Liability, Waiver of Claims, Assumption of Risk, and Indemnity Agreement ("Agreement") is entered into by the undersigned participant ("Participant," and if a minor, together with Participant's parent or legal guardian) in connection with Participant's enrollment in, attendance at, and participation in classes, training, sparring, seminars, open mat sessions, competitions, and other activities ("Activities") offered by 85 Jiu Jitsu LLC, doing business as 85 Jiu Jitsu, including its owners, coaches, instructors, employees, contractors, and agents (collectively, the "Academy").

1. Assumption of Risk
Participant understands that Brazilian Jiu-Jitsu, grappling, submission wrestling, and related mixed martial arts training ("BJJ Training") are physically demanding, contact-based activities that carry inherent and significant risks, including but not limited to:

  • Joint locks, chokes, strikes, throws, takedowns, and other techniques applied by training partners or coaches;
  • Sprains, strains, fractures, dislocations, concussions, cuts, bruising, and other soft-tissue or orthopedic injuries;
  • Exposure to communicable illness or infection (including skin infections such as ringworm or staph) through close physical contact;
  • Injury resulting from the action, inaction, or negligence of other participants, some of whom may be inexperienced;
  • Equipment or facility conditions, including mats, mirrors, and training gear; and
  • Aggravation of a pre-existing injury or condition.

Participant voluntarily and knowingly assumes all such risks, known and unknown, and understands that these risks cannot be eliminated regardless of the care taken to avoid injury.

2. Release and Waiver of Claims
To the fullest extent permitted by law, Participant, on behalf of themselves and their heirs, executors, administrators, assigns, and next of kin, hereby releases, waives, discharges, and covenants not to sue the Academy from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by Participant while participating in Activities, or while on the Academy's premises, whether caused by the negligence of the Academy or otherwise, except as provided in Section 3 below.

3. Limitations on Release
Nothing in this Agreement releases or waives claims arising from the Academy's gross negligence, recklessness, or intentional misconduct, or waives any right or protection that cannot lawfully be waived under California law. This Agreement is intended to be as broad and inclusive as permitted by the laws of the State of California, and if any portion is held invalid, the remainder shall continue in full force and effect.

4. Medical Treatment Authorization
In the event of injury to Participant during an Activity, Participant authorizes the Academy to secure and administer, or arrange for, emergency medical treatment, including transport to a medical facility, and agrees that Participant (or, if a minor, Participant's parent/guardian) is financially responsible for all costs of such treatment. The Academy carries no medical or health insurance covering Participant, and Participant is encouraged to maintain their own health insurance coverage.

5. Rules, Etiquette, and Coach Instruction
Participant agrees to follow all Academy safety rules, mat etiquette, and the reasonable instructions of coaches and staff, including tapping out promptly when in danger of injury and communicating any pre-existing injuries or medical conditions before training. The Academy reserves the right to remove any participant from an Activity for unsafe conduct.

6. Photo/Video Release
Participant grants the Academy permission to photograph and video record Participant during Activities and to use such images or footage for the Academy's promotional, social media, and marketing purposes, without compensation. Participant (or parent/guardian) may revoke this permission in writing at any time; revocation will not affect prior use.

7. Indemnification
Participant agrees to indemnify and hold harmless the Academy from any loss, liability, damage, or cost the Academy may incur due to Participant's presence in or participation in Activities, whether caused by the negligence of Participant or the negligence of others, to the fullest extent permitted by law.

8. Governing Law
This Agreement shall be governed by the laws of the State of California. Participant agrees that any dispute arising from this Agreement or Participant's participation in Activities shall be resolved in the state or federal courts located in Riverside County, California.

9. Acknowledgment
Participant states that they are of lawful age and legally competent to sign this Agreement, or that the signature below is that of a parent or legal guardian with full authority to bind the minor Participant. Participant has read this Agreement in its entirety, understands its terms, understands that they are giving up substantial legal rights, including the right to sue, and signs it voluntarily and of their own free will. This waiver applies to the signer and the attendee named on this booking, including if the attendee is a minor.
